KC Broadband Terms of Service Last Updated: January 15, 2026
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and KC Broadband (“we,” “us,” or “our”), a wireless internet service provider based in Kansas. By subscribing to, accessing, or using our wireless broadband internet services (the “Service”), visiting our website, or otherwise engaging with us, you agree to be bound by these Terms, our Privacy Policy (available on our website), and any applicable service order, quote, or agreement.
If you do not agree to these Terms, do not use the Service.
1. Service Description
We provide fixed wireless broadband internet access using radio signals from our towers or access points to customer premises equipment (CPE), such as an antenna and modem/router installed at your location. Service availability, speeds, and performance depend on factors including line-of-sight to our tower, distance, terrain, weather, local interference, network congestion, and your equipment configuration.
Advertised speeds are “up to” maximums based on typical conditions; actual performance may vary. We do not guarantee specific speeds, latency, or uninterrupted service. Refer to your service plan details or our broadband consumer label for expected typical speeds, and other characteristics.
2. Term and Termination
Term: Service begins upon successful installation and activation and continues on a month-to-month.
Cancellation by You: You may cancel at any time by providing notice (email, phone, or written) at least 30 days in advance.
Termination by Us: We may suspend or terminate service immediately for non-payment, violation of these Terms, abuse, fraud, illegal activity, or if service becomes technically or economically infeasible. We may also terminate with 30 days’ notice for any reason.
Post-Termination: Upon termination, you must return or allow removal of our equipment. You remain responsible for all charges until the effective termination date.
3. Equipment and Installation
Our Equipment (CPE): We own the antenna, radio, modem, and related hardware provided for the Service. It remains our property even after installation. You grant us a license to install, maintain, repair, or remove it on your property.
Installation: We or our contractors perform professional installation. You must provide safe access, power, and mounting locations. Additional fees may apply for complex installs.
Your Responsibility: Secure your internal Wi-Fi network with a strong password. We are not responsible for issues arising from your internal network, devices, or misuse.
Return/Damage: Upon termination, return equipment in good condition (normal wear excepted) within 15 days or pay replacement costs.
4. Billing and Payment
Charges: You agree to pay all monthly recurring fees, installation/setup fees, equipment fees, taxes, surcharges, and other charges.
Payment Terms: Bills are due on the date specified. Late payments incur fees. We may suspend service for non-payment after notice.
Auto-Pay: Encouraged; you authorize recurring charges to your card/bank.
Disputes: Notify us of billing errors within 60 days.
5. Acceptable Use Policy
You agree not to use the Service for:
Illegal activities
Spam, phishing, malware distribution
Excessive automated use or bandwidth consumption that disrupts the network
Hosting servers, reselling/sharing the Service without permission
Copyright infringement or other IP violations
Any activity that violates our network management practices (reasonable measures to ensure fair access, security, and performance)
We may monitor usage for network management, not content inspection beyond what’s needed for operations.
6. Network Management and Open Internet
We engage in reasonable network management to optimize performance, prevent harm, and comply with law, consistent with FCC transparency rules. This may include prioritizing emergency communications, mitigate congestion, or block malicious traffic. We do not block lawful content, throttle based on content, or engage in paid prioritization.
7. Limitations of Liability
THE SERVICE AND EQUIPMENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY.
You acknowledge wireless service may be affected by factors beyond our control (weather, interference, power outages, etc.).
8. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
9. Governing Law and Dispute Resolution
These Terms are governed by Kansas law. Any disputes shall be resolved in the state or federal courts located in Kansas. You waive jury trial and agree to binding arbitration for certain claims if required by applicable law.
10. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified via email, bill message, or website posting.
11. Miscellaneous
Entire Agreement: These Terms, your service order, and our Privacy Policy constitute the full agreement.
Severability: Invalid provisions do not affect others.
No Waiver: Failure to enforce a right does not waive it.
Assignment: We may assign these Terms; you may not without our consent.
